Terms of Service

By accessing or using the Destination Launch website at destinationlaunch.com or by enrolling in any Destination Launch program, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this site or enrolling in any program.

These Terms of Service apply to all visitors, applicants, enrolled participants, and anyone who accesses our website or communicates with us about our programs.

Destination Launch is a web application development cohort program operated by HUFF Real Estate Group, LLC, a Texas limited liability company. The program is offered at two locations — Port Aransas, Texas and San Antonio, Texas — and is designed to help non-technical founders build and launch a web application MVP.

Destination Launch is not a licensed educational institution, accredited school, coding bootcamp, or academic program. It is a professional development and coaching program. Completion of the program does not result in any academic credit, certification, or degree.

You may use the Destination Launch website for lawful purposes only. You agree not to:

• Use the website in any way that violates applicable federal, state, or local laws or regulations
• Attempt to gain unauthorized access to any portion of the website or its related systems
• Transmit any unsolicited or unauthorized advertising or promotional material
• Use automated tools including bots, scrapers, or crawlers to access or collect data from the website without our express permission
• Impersonate or attempt to impersonate Destination Launch, any of its staff, or any other person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the website
• Introduce any malware, viruses, or other malicious code

We reserve the right to terminate access to the website for any user who violates these terms.

Enrollment in a Destination Launch program is subject to the following conditions:

• Completion of a discovery call with the program facilitator
• Acceptance into the program at the sole discretion of Destination Launch
• Successful completion of a background check
• Signing the Program Participation Agreement
• Payment of the program fee in full or via an approved payment plan
• Meeting the age requirement of 18 years or older (or providing parental consent if under 18)

Acceptance into a program does not guarantee a confirmed spot until all enrollment conditions are met. Spots are confirmed in order of completion of all enrollment requirements.

Destination Launch reserves the right to decline any application for any reason and to remove any enrolled participant from the program for violation of the Code of Conduct, as defined in the Program Participation Agreement.

Program fees are as follows:

• Port Aransas program — $6,500 per participant (all-inclusive)
• San Antonio program — $2,500 per participant

Payment is processed via Stripe. By providing payment information you authorize Destination Launch to charge the applicable program fee. All fees are non-refundable as detailed in our Refund Policy.

For payment plans, you authorize Destination Launch to charge the deposit amount immediately upon enrollment confirmation and the balance amount on the agreed balance due date. Failure to pay the balance by the due date may result in forfeiture of your spot without refund of the deposit.

Destination Launch content: All content on the Destination Launch website and in program materials — including text, graphics, logos, images, the SpecForge framework, curriculum, session guides, and methodologies — is the property of HUFF Real Estate Group, LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Destination Launch content without express written permission.

Your application: You retain full ownership of the web application you build during the program. Destination Launch makes no claim to ownership of your application, its source code, or its intellectual property. The revenue share arrangement described in the Program Participation Agreement is a financial arrangement only and does not convey any ownership interest in your application.

Your content on our platforms: If you post content to any Destination Launch communication channel including cohort Slack or Discord workspaces, you grant Destination Launch a non-exclusive license to use that content for program facilitation purposes.

Destination Launch makes the following important disclosures:

• No launch guarantee — While the program is designed to guide every participant to a launched MVP by Demo Day, we cannot guarantee that every participant will successfully launch an application. Success depends on the participant's effort, idea scope, commitment, and factors outside our control.
• No revenue guarantee — We make no guarantee or representation regarding the revenue potential of any application built during the program. Any revenue projections discussed are illustrative examples only.
• No employment guarantee — Completion of the program does not guarantee employment, freelance work, or any specific career outcome.
• No technical guarantee — Third-party platforms including Lovable, Replit, Supabase, and Stripe may experience outages or changes that affect program delivery. We are not responsible for third-party platform failures.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HUFF REAL ESTATE GROUP, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO:

• Your use of or inability to use the website or program
• Any content on the website or in program materials
• Any program activities including Port Aransas recreational activities
• Any technical failures of third-party platforms used in the program
• The performance or non-performance of any application built during the program

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE TOTAL PROGRAM FEE YOU PAID TO DESTINATION LAUNCH.

You agree to indemnify, defend, and hold harmless HUFF Real Estate Group, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms of Service
• Your violation of any rights of a third party including intellectual property rights
• Your conduct during or in connection with the program
• Any content you submit, post, or transmit through any Destination Launch channel

The Destination Launch website may contain links to third-party websites and services including Google Calendar for booking, Stripe for payments, Lovable and Replit for program tools, and getspecforge.com for the SpecForge framework. These third-party services have their own terms of service and privacy policies which govern your use of those services.

We are not responsible for the content, privacy practices, or terms of any third-party websites or services. Links to third-party sites do not constitute endorsement of those sites or their content.

All program participants are required to adhere to the Code of Conduct as defined in the Program Participation Agreement. By enrolling in a program you agree to the Code of Conduct and acknowledge that violation may result in immediate removal from the program without refund.

The Code of Conduct applies to all program interactions including virtual sessions, in-person sessions, cohort communication channels, and any other interaction with fellow participants, staff, or guests.

During the program you will be exposed to other participants' app ideas, business plans, and proprietary information. You agree to keep all such information strictly confidential and not to use any participant's proprietary information for your own benefit or share it with third parties.

This confidentiality obligation survives completion or termination of your program participation.

These Terms of Service and any disputes arising from them are governed by the laws of the State of Texas without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising from or relating to these Terms of Service or your use of the website or program shall be resolved by binding arbitration in San Antonio, Bexar County, Texas under the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action lawsuit.

Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

Destination Launch reserves the right to terminate or suspend your access to the website or remove you from a program at any time for any reason including violation of these Terms of Service, violation of the Code of Conduct, or any conduct we deem harmful to other participants or the program.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

We reserve the right to update these Terms of Service at any time. When we make changes we will update the "Last updated" date at the top of this page. Material changes will be communicated to enrolled participants via email. Your continued use of the website or enrollment in a program after any changes constitutes acceptance of the updated Terms of Service.

We recommend reviewing these Terms periodically to stay informed of any updates.
